2. Purchuaser is a person who is a user registered in ICMARKET system. In further parts of the statue with reference to the purchuaser alternatively are used following definitions: customer, client, user, buyer.
3. Orders in ICMARKET are placed within 24 hours per day in all 7 days of a week through the medium of internet service www.icmarket.pl.
4. .In the event of any comments, remarks or questions concerning ICMARKET operations can be sent on the following address or through the e-mail sklep@icmarket.pl.
5. Internet wholesale firm - ICMARKET leads wholesale sale and retail by mediation of network Internet. Orders are accepted by internet page - www.icmarket.pl, by the agency of e-mail on address - sklep@icmarket.pl and tele-fax - 052-342-77-93.
6. The condition of realisation of an order is : - foundation of client's account in ICMARKET correct fulfillment of form in ICMARKET service or an application of essential information to business advisor.
7. User is beholden for updating his personal data.
8. User is obliged to keep in secret his login and individual password as well as to secure them from access of third party.
9. In case of infringement of conditions of use by the user, particularly, in situations: an application of false personal data, unaccomplishment of actualization served personal data within the time of 1 year from the last actualization, disclosure of one's own login or password to the third party, ICMARKET reserves the right to interlocking the access to service at any time.
10. Registration (foundation of account) in ICMARKET is equivalent to giving an agreement on sending advertising information to persons and firms, as well as other information in the form of e-mail.
11. Registration of the user - client in the service means agreement on storage and processing of personal data included in the registration form by ICMARKET in accordance with obligatory regulations of act about personal data security Pz.U.N 133 poz.883.
12. ICMARKET processes personal data of registered users for the purpouses essential for establishing, forming of content, modification or termination of legal relationship, as well as for marketing. Those data are introduced into the database and intended only for ICMARKET firm.
13. The user has right to insight into his own personal data and possibility of data's change. Taking advantage of the right to claim for deleting personal data from the ICMARKET system is realised by sending relevant request together with name, surname, login and password assigned to the user through e-mail to the data administrator.
14. Claim for deleting personal data from ICMARKET system is equivalent to user's logoff from the service system.
15. Registration in ICMARKET means accepting decisions incuded into the regulation.

17. Ordering of goods determines following conditions:
    - assortment
    - quantity
    - time of delivery
    - place of delivery
    - name of the consumer
    The course of order's implementation after selection of the material within the time of its formation, 'offer question' option or 'individual question' do not cause dispatch of materials.
18. Consumer will be notified of order's acceptance through the e-mail medium.
19. Acceptance of order will be acknowledged within 2 working days.
20. ICMARKET may call on the CLIENT for the confirmation of the placed order. The lack of confirmation in 3 days time might cause the cancellation of the order.
21. Adding the selected item to the cart in ICMARKET is not equivalent to buying it.
22. The photographs in the descriptions of the articles do not always make the exact image of the particular items. Despite of the efforts for the precise picturing and precise transmission of the information by ICMARKET, the goal of the photographs is only the general orientation of the CLIENT in some of the product's features. For that reason, the difference between the image of the original delivered product and the photograph placed in ICMARKET may not determine qualifying the product as inconsistent with the order.
23. All the prices presented in ICMARKET are the gross prices in polish zlotys and include VAT. There is also information about the net price available on the sites of the particular items. Within the ICMARKET website the mechanism of presenting the prices in US dollars and Euro is also available.
24. The prices presented on the website may be reduced due to the additional discount.
25. The price on the pro forma invoice sent to the e-mail address of the client is binding for the parties of the transaction. The pro forma invoice includes the information about the unit prices of the items and the total price of the transaction including the cost of shipping the order to the client.
26. All the promotions and sales within the ICMARKET are valid until the stock runs out.
27. The client may not demand the order's fulfillment in the promotional prices for all ordered quantities. Such orders are fulfilled fully or partially depending on the stock of ICMARKET.
28. The payment methods accepted by ICMARKET include: bank transfer, credit card and cash: pre-payment to the bank account - according to the e-mailed pro forma invoice, cash on delivery - to the courier or carrier, bank transfer with the delayed date.
29. The method of payment suggested by the CLIENT requires the acceptation of ICMARKET.
30. There is also a possibility of purchasing on installments within the Żagiel system.
31. Furthermore, customer can exercise the right to use agency www.platnosci.pl.
32. In the event of transfer payment, goods are packed and sent to the customer after booking the payment from the customer on the ICMARKET's bank account.
33. In the event of some sort of assortment made to special order complemented deliveries, ICMARKET reserves the right to limitation the way of payment through elimination of the ability to pay on delivery.
34. In the event of installment offer, goods will be sent after receiving confirmation of an installment agreement by ICMARKET.
35. In the event of transfer or credit card after booking of payment.
36. Customer is notified for the proposed date of realisation of an order through the agency of e-mail. Ultimate customer's agreement concerning the date of delivery is executed through the agency of e-mail after accepting a proposed term of delivery by ICMARKET.
37. In the events of goods' damages caused by ICMARKET deliverers or carrying companies delivering goods, ICMARKET reserves the right to agreement with customer the new time of delivery.
38. ICMARKET reserves the right to annulment the order in the event of delivery time's acceptance by the customer or cessation of correspondence on the subject of delivery's time for longer than 7 days.
39. ICMARKET is not responsible for delays in delivery due to unfulfilment of contract with transport and postal servicing.
40. Delivery is organised through the way preffered by the consumer in the process of selecting goods for order. With the option - optimal transport - conditions of delivery are determined by ICMARKET's commercial advisor after contact with purchuaser within 48 hours/ working days.
41. ICMARKET implements deliveries by means of specialized transport companies or ICMARKET's own transport. It is possible to collect goods in person by the consumer or transport company indicated by the purchuaser after determining place of receipt.
42. Approximate cost of transport of the goods to the client is HERE.
43. Ultimate and biding costs of consignment are determined by ICMARKET. Information concerned with the level of the goods' delivery's cost is transferred through the agency of e-mail, before the delivery and while discussing definitive financial conditions in the form of pro forma invoice.
44. Information about free transport on the account of respectively great number of goods ordered by the consumer is transferred through the e-mail.
45. In the event defined by ICMARKET's deliverers to the total price of transaction can be added price for the pallet, other package or bail for the returnable package. Information about the cost of pallets or payable packages are transferred through the e-mail, before the delivery and while discussing definitive financial conditions in the form of pro forma invoice.
46. Couriers are obliged to bringing consignments with the weight not more than 31,5 kg by going up the stairs. In accordance with transport law courriers are not under an obligation to carrying heavier packages.
47. To each order is made out an in-voice VAT, which is sent to consumer by post within the term of 7 days from the date of goods' delivery.
48. The moment of conclusion of purchuase-sale agreement takes place during written confirmation of goods' receipt by the purchaser on the consignment note.
49. While collecting consignment consumer is obliged to verificate its conformity with an order. Purchuaser receives the right to be the goods owner and be responsible for all risks connected with possession and utilization of commodity.
50. In the event of ascertainment of consignment's damage one should refuse its acceptance and draw up a damage survey protocol.
51. In accordance with valid transport law client who have noticed damage of the consignment after courier's departure may notify that fact to the courier's company by phone. Deliverer is obliged to send in courier at the place of delivery within 7 days from the date of the consignment's delivery in order to draw up a damage survey protocol. Claims for refund due to mechanical damages, caused during the transport will not be investigated without correctly filled in damage survey protocol with courier delivering the consignment and without manufacturing package of advertised article.
52. All commodities purchuased in ICMARKET are machinery new, free from physical and legal faults as well as they have been legally introduced to the market with producer's guarantee.
53. Complaints are accepted by ICMARKET Call Center, tel-fax 0-52 - 342-77-93, e-mail sklep@icmarket.pl after filling in by the client who claims for refund conditions described in hereby regulation.
54. According to act from 2 March 2000 about protection of some rights of clients and about responsibility for the damages inflicted by the dangerous product (Dz. U. Nr 22, poz. 271, z 2000r z poz. zm.), buyer has right to withdrew from an agreement of purchuase within the time of 10 days from the date of goods' delivery without stating any reasons by sending a letter of recession from a contract on the address of ICMARKET's headquarters. Condition of repayment is intact condition of the articles and undamaged package. Otherwise, ICMARKET reserves the right to deduction of costs of new articles' package, additionally, costs of repeated material's packing.
55. Person who terminates a contract is charged with responsibility for procurement of the goods and together with copy of recession from a contract to ICMARKET's headquarters within the term of 14 days from the date of sending the letter of withdrawing from a contract. Costs of procurements and responsibility for damages caused during transport of returned or complained articles bear claimant. Money for undamaged and returned commodity is returned with the use of transfer on the bank account indicated by the person terminating a contract (buyer) within 14 days.
56. ICMARKET bears responsibility for 2 years from the date of purchuase in the evidence of discrepancy in commodity with contract in accordance with 10th Article of Act (Art.10) about specific conditions of consumer sale from 27th July 2002. Consumer will lose entitlements clearly-defined in the Act above mentioned if he does not notify the shop within two months from identification of discrepancy in goods and contract about that discrepancy.
57. In the event of discrepancy in articles with a contract, complained materials together with a letter that describes inconsistencies and expecations concerning the way of realisation of our obligations one should dispatch at ICMARKET expense by means of courier's firm DHL on the address of ICMARKET's headquarters. In that order, please, contact with our firm to get the declaration of complainment number.
58. Determining the way of realisation of ICMARKET's obligations, purchuaser has the right to demand bringing commodity to a satisfactory state in accordance with a contract through a free repair or exchange unless the repair or exchange are impossible or require excessive costs. If the shop does not be able to fulfil certain requests the customer has the right to claim for applied reduction of the price or can retract from an agreement.
59. ICMARKET will take an attitude towards customer's requests within the time of 2 working days from the moment of notification concerned inconsistency of goods ordered. If the case requires additional technical expert appraisements carried out by external companies that time limit can be prolonged to 14 days. If ICMARKET does not take an attitude towards customer's requests within 14 days it means that request has been recognized as well-founded.
60. If notification of inconsistency of goods ordered ensues within 10 days from the moment of purchuase consumer has the right to request for exchange of the product into new one under hastened course. Hastened course concerns only products which bear no trace of utilization. If inconsistency is acknowledged and complained commodity is avaliable in ICMARKET's stock new commodity will be sent within 2 working days since delivery of inconsistent cmmodity to ICMARKET. If it is impossible to happen ICMARKET will offer equivalent of the product's price to the purchuaser or propose other avaliable commodity in ICMARKET with alike parameters.
61. In any above mentioned event when realisation of client's requests connects with delivery of new or repaired commodity all costs of delivery bear ICMARKET.
62. The team of ICMARKET does its best so that descriptions and technical data of products located in ICMARKET service are consistent with reality. Technical data are administered on the basis of information drawn from information materials and promotional producers of materials and appliances. However, we do not bear responsibility for icorrect stating of parameters and characteristic of commodity or sudden commodity's change by its producer. Nevertheless, in every case when data (in it descriptions and technical data of products) presented in ICMARKET service in the day placing an order by the customer would not agree with reality in accordance with regulations about withdrawal from an agreemenet drawn up on a distance, he has right to retract from an agreement without stating reasons within 10 days from the date of purchuase.
63. ICMARKET does not as well bear rsponsibility for the user's decisions made on the basis of information obtained as a result of using service's resources.
64. Offer presented in the ICMARKET service does not constitute commercial offer according to 543rd Article Civil Code.
65. In unregulated situations mentioned above appropriate regulations of Civil Code and other legal regulations are applied.
66. When any change in regulation its serving to users will procede through placing at the pages of ICMARKET.
67. The form of products' description and the form of products' photographs originate from database which constitutes property of ICMARKET company.
68. The pages of agreement oblige to settle ligitations resultant in connection with execution present agreement by compromise.
69. In the event of arbitrational dissolution's absence, ligitations between both parties will be subordinated to settlement by the court in Bydgoszcz.
70. ICMARKET does not bear responsibility for the damages resultant from damages of user's computer equipment or its data resources, in the course of or with connection to the utilization from the service's resources, in particular, penetration of the computer viruses into the user's information system.
71. User - consumer is responsible for the damage resultant from exposure individual login and password to an unauthorized entity.
72. Moreover, ICMARKET does not bear responsibility for the lack of service's resources arised in connection with breakdown of telecommunications' system and for other consequences of defective operations of telecommunications' trunk lines and damages induced by those damages .
